eStatement Agreement & Disclosure
eStatement Requirements:
- Personal computer with Windows 10 and newer operating system, or Mac OS X and newer operating system
- Most current stable version of Mircosoft Edge, Mozilla Firefox, Google Chrome, or Apple Safari
- Adobe Acrobat Reader 20.0.1 or higher
- Established Retail Online Banking Username and Password
- Internet Connectivity
eStatement Client Agreement:
- In consideration of the eStatement services to be provided by First State Bank as described from time to time in information distributed by First State Bank to its clients, the undersigned client agrees as follows:
- The undersigned hereby requests and authorizes First State Bank to make notification of regular periodic account statement(s) to the client, in lieu of a paper copy, in electronic format for all accounts that the client has listed on the eStatement Signup Form to be viewed through First State Bank’s Retail Online Banking service. By utilizing First State Bank’s eStatement services, the client agrees to be bound to all rules and regulations applicable to the client’s accounts and any other contract for services at First State Bank as established and amended by First State Bank.
- The client agrees to receive initial and periodic account disclosure information in an electronic format. First State Bank will provide this information in a clear, conspicuous manner so that the client can print and/or store using the hardware and software specified above. A copy of said disclosures may also be viewed at First State Bank’s web site, www.fsb.bank. The consent granted by this paragraph applies to all accounts identified on the eStatement Signup Form. First State Bank will notify the client of any material change in hardware or software required for retrieving or storing this disclosure information and provides the client with an opportunity to withdraw his/her consent.
- The client understands their right to revoke this agreement and thereby withdraw consent to communicate with First State Bank electronically. In order to withdraw consent and terminate this agreement, the client must notify First State Bank in writing, 30 days in advance, of this decision delivered to First State Bank at the following address: First State Bank, Attn: Virtual Services, 24300 Little Mack, St. Clair Shores, Michigan 48080. There could be a $3 Paper Statement fee associated with rescinding this agreement depending on the type account you currently have.
- The client understands that he/she has a right to obtain a paper copy of any of the above-described disclosures or eStatements. To obtain a paper copy, the client must make a specific request to First State Bank at the above address or call us at 586-775-5000. In some cases, research fees specified in First State Bank’s schedule of fees and charges may apply to the client’s request pursuant to this paragraph.
- The client agrees to notify First State Bank immediately if he/she is unable to access any of the information that has been delivered by the BANK in an electronic form or manner.
- The client agrees to provide First State Bank with signed, written notice of his/her electronic mail address changes. Notice shall be sent to the address listed above.
- The client must log into online banking at least once every 13 months or their online banking account will become inactive and deleted. If your online banking account is deleted, paper statements will be printed and mailed to the current address we have on file for accounts using our eStatement Service. A $3 Paper Statement fee could apply depending on the type of account you currently have.
First State Bank shall not be responsible or liable (to the extent allowable by law) for:
- Consequential or incidental damages for negligent performance by First State Bank of its eStatement services.
- Damages arising from unauthorized access to eStatement services.
- Any costs associated with updating, modifying or terminating the client’s software or hardware.
Additional Terms:
The client represents and warrants to First State Bank that each individual who is to have access to the client’s accounts and information through eStatement services is hereby authorized to access this account information. Each client will also designate a password as required by First State Bank’s Retail Online Banking services. Generally, passwords shall consist of at least nine alphanumeric characters. Once selected for each user, a password is to be used only by that individual and protected from use by others. The client agrees that First State Bank’s security procedures are commercially reasonable.
- Unless otherwise noted, the meaning of terms used in this agreement and information incorporated herein shall be defined by the applicable provisions of the Michigan Uniform Commercial Code.
- The laws of the State of Michigan shall govern this agreement and all transactions hereunder. The client acknowledges that he/she has reviewed the eStatement Agreement & Disclosure, understands the terms and conditions set forth herein, and agrees to be bound hereby.
- This agreement may be terminated or modified by First State Bank at any time and for any reason without advance notice to the client.
- Client agrees to be bound by future modifications of this agreement, which will be made available to the client on the First State Bank's website.
